Public Offer (Terms & Conditions)
Agreement of Sale This Public Offer constitutes a legal agreement between Smart Pick and Pay ("The Seller") and the customer ("The Buyer"). By placing an order on smartpickandpay.co.za, you agree to the terms outlined below.
1. Product Pricing & Availability
- All prices are listed in South African Rand (ZAR).
- While we strive for 100% accuracy, Smart Pick and Pay reserves the right to cancel orders arising from "obvious errors" in pricing (e.g., a R5000 TV listed for R50).
- Stock availability is updated regularly, but in cases where an item is sold out after an order is placed, we will offer a full refund or an alternative product.
2. Payment & Security
- Payments are processed securely via PayFast. We do not store your credit card details on our servers.
- Ownership of goods remains with Smart Pick and Pay until full payment has been received and cleared.
3. Delivery & Collection
- We offer nationwide delivery and in-store collection at Shop F29, Block F, China Mall, Johannesburg.
- The risk of loss or damage passes to the buyer once the package has been delivered to the specified address.
4. Warranty & Liability
- Many of our electronics and solar products carry specific manufacturer warranties. Please retain your invoice for any warranty claims.
- Smart Pick and Pay is not liable for any damages resulting from the incorrect installation or misuse of products (specifically solar and electrical components).
5. Governing Law
- These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).
